The lot on which the strip mall is to be built has been zoned residential for the longest time. It is part of a large block of "low-density residential" lots on Route 94 across the road from the Chateau Hathorn. This lot was suddenly rezoned as commercial with no notice to nearby residents. The Town Board asserts that no notice was required, since the whole Town was notified that rezoning was being done as part of revisions to the Master Plan.
The lot was rezoned to something called "Designed Shopping". This is the same zoning ShopRite has. In the Warwick zoning law, Designed Shopping is defined as: The purpose of the Designed Shopping District is to allow community-scale commercial uses that rely heavily on automobile and truck access and that would not be compatible with a traditional hamlet neighborhood area. "Community-scale" means very large: businesses that attract large numbers of customers from a large area of the town, such as ShopRite. A 2-acre lot cannot possibly fit this description. It is too small to house a "community-scale" business and certainly too small to support "commercial uses that rely heavily on automobile and truck access", especially on our section of road.
